Abstract

Law 40/2011 modifying the Labour Code from 2003 aimed at remodelling the legal framework of the labour relationships to the economic requirements of the market and at their synchronisation with the European legislation. Although the intention of the legislator is to achieve the aforementioned objective, the new legal norms can be open to criticism because they loosen the exigency regarding the representation conditions of the employees and they do not finalise the procedure for the damage recovery through the employee’s damage liability.
